MINI SESSION TERMS AND CONDITIONS
This agreement contains the entire
understanding between Ashley Clayton Photography and the Client. It supersedes
all prior and simultaneous agreements between the parties. The only way to change
or add to this agreement is to do so in writing, and providing the document is
signed by all the relevant parties.
RESERVATION
Upon booking, Ashley Clayton Photography
will reserve the time and dates agreed upon, and will not make other
reservations for the time and dates. For this reason, the Reservation Deposit
of $50 is nonrefundable, including acts of God, fire, strike and/or extreme
weather, and may result in a credit for future services being issued. The Reservation
Deposit is to be paid at time of signing the contract via PayPal or Venmo to
ashleyclayton@gmail.com. The Reservation Deposit is applied towards the
contracted photography package. The Client understands and agrees that the
entire amount owed for the photography package described in the contract is due
by completion of the shoot.
If the Client misses the time slot
agreed upon for any reason including traffic, misunderstood directions, etc. it
will be at the discretion of Ashley Clayton Photography to perform the mini
portrait session at a different time if one is available because of the strict
schedule of the day. This also includes clients that are late. Ashley Clayton
Photography is only responsible for the time agree upon in this contract.
Please allow extra travel time to avoid missing the time slot listed above.
PHOTOGRAPHY PACKAGE INCLUDES
Time and talent of Ashley Clayton Photography
Twenty minutes of shooting
Twenty-five professionally edited, high
resolution images
Online gallery with print and download option
Ashley Clayton Photography shall have up
to 7 days to fully edit the images, at which time she will send an email with a
link to an online gallery where The Client can download or print the images.
PRINT RELEASE
The Client has purchased high-resolution
digital files from the Ashley Clayton Photography mini portrait session. The
Client is hereby granted permission by Ashley Clayton Photography to reproduce
the images and make an unlimited number of prints, for personal use only. This permission applies worldwide. The
client agrees that he/she may not use any images for commercial or editorial
purposes. Ashley Clayton Photography
retains the copyright to all images, per USC Title 17 (US Copyright Law).
CLIENT FILES
The Client will have access to the
online gallery for one year after the mini portrait session. Ashley Clayton Photography
does not warrant the longevity of any digital media or files delivered to the
Client. The Client bears the sole responsibility for backing up, archiving, and
maintaining the integrity of the files. The Client may purchase copies of the
files on a flash drive within 6 months of the mini portrait session for an
additional $25 per flash drive.
TERMS AND CONDITIONS
The Client agrees that the deposit is
required at the time of booking and 100% of the remaining balance is due at the
completion of the mini portrait session.
Deposit of $50 is due within 72 hours of
booking
Remainder of $150 is due upon completion
of the mini portrait session
**ADDITIONAL SERVICE** $50 for expedited
image delivery is due upon completion of the mini portrait session
The total amount of this contract is:
$200 or $250 with expedited turn around
Payment of Cash, Check made payable to
Ashley Makowski, PayPal or Venmo transfer is accepted.
CANCELLATION BY PHOTOGRAPHER
If Ashley Clayton Photography cannot
perform this contact due to fire or other casualty, strike, act of God or other
cause beyond the control of the parties, or due to Ashley Clayton Photography’s
illness or emergency, then Ashley Clayton Photography shall return the deposit
to the Client but shall have no further liability with respect to the contract.
This limitation on liability shall also apply in the event that photographic
materials are damaged in processing, lost through camera or media malfunction,
lost in the mail, or otherwise lost or damaged without fault on the part of
Ashley Clayton Photography. In the event Ashley Clayton Photography fails to
perform for any other reason, Ashley Clayton Photography shall not be liable
for any amount in excess of the retail value of the Client’s order.
If, in the opinion of Ashley Clayton
Photography, inclement weather or other adverse conditions prevent the creation
of portraits or the artistic standards of Ashley Clayton Photography, Ashley
Clayton
Photography may elect to exercise the
“Rain Date” or an alternative location for the mini portrait session. If the
“Rain Date” is utilized the agreed time slot will not change.
MODEL RELEASE FOR ALL PARTICIPANTS OF
MINI SESSION (including all minors)
The Client hereby assigns and grants
Ashley Clayton Photography and its legal representatives the irrevocable and
unrestricted right to use and publish photographs of the Client or in which the
Client may be included, for editorial, trade, advertising or any other purpose
and in any manner and medium; to alter the same without restriction; and to
copyright the same. The Client hereby releases Ashley Clayton
Photography and its legal
representatives and assigns from all claims and liability relating to said photographs
including any and all claims for libel and invasion
of privacy. It is agreed that Ashley Clayton Photography may display and
use the photographs taken for advertising, website and internet promotion,
photographic contests, photography books, photography instructional books, and
any other purpose thought proper by Ashley Clayton Photography. Ashley Clayton
Photography will not sell or license photographs of the Client.
ADDITIONAL NOTES
The charges in this contract
are based on Ashley Clayton Photography’s mini portrait session price list. The
price list is adjusted periodically and future orders shall be charged at the
prices in effect at the time when the order is placed.
CONTRACT REVISIONS
Revisions to this Contract
will be considered agreed to by Provider and Client when 5 days written notice of
requested changes have been signed by both parties.
ENTIRE UNDERSTANDING
The agreement contained in
this Contract constitutes the sole agreement between Provider and Client regarding
its Photography Service. It becomes effective when service is booked. This agreement
shall be governed and construed in accordance with the laws of the State of
California.
